DECLARATION
OF BOATING ACTIVITY EXEMPTION
Parks Victoria as the declared waterway manager for the
Local Port of Port Philli, including Patterson Lakes, makes
the following declaration under section 203(3) of the Marine Safety Act 2010 (Vic).
For the purposes of
boating activity conducted by Patterson Lakes Outrigger Club, persons and
vessels involved in the Patterson Lakes Outrigger Regatta are exempt from the
following requirements:
State
Rules made under the Marine Act 1988
1.
Clause 2(a) – must not exceed 5 knots within 50 metres of a person in
the water
2.
Clause 2(c) – must not exceed 5 knots within 50 metres of another vessel
3.
*Clause 3(a) – must not exceed 5 knots within 50 metres of the water’s
edge
4.
*Clause 3(b) – must not exceed 5 knots within 50 metres of a fixed or
floating structure
5.
Clause 4(a) – must not exceed 5 knots within 200 metres of the water’s
edge
6.
Clause 4(b) – must not exceed 5 knots within 50 metres of a wharf,
jetty, slipway, diving platform or boat ramp

Subject to the conditions detailed below:
·
Masters of rescue vessels are only exempt from item 1-2 & 5-7 when
undertaking a rescue operation to retrieve persons in distress, provide for
their initial medical or other needs and deliver them to a place of safety on
shore
·
Competitors are only exempt from items 2 & 5 - 7 when competing in
the events, and item 2 applies only when within 50 metres of another competitor
or competing vessel
·
Masters of rescue vessels and competitor vessels are only exempt from
items *3-4 & 8 for the duration of the event if held in back up location Patterson
Lakes on inland waters
·
All occupants of mechanically powered vessels involved with the event
must wear a lifejacket at all times during the event and all rescue vessels
must carry prescribed safety equipment
·
All participants on canoes involved with the event must wear a
lifejacket at all times
·
The exemptions apply from 8:00am – 4:00pm on Saturday 18 April and
Sunday 19 April 2026 within the waters North and South of Carrum Beach (back-up
location Patterson Lakes)
·
In the event of any injuries
which result in hospitalisation, a fatality or an incident involving a person
or vessel not involved in the event, these must be immediately reported to
Victoria Police and Safe Transport Victoria (ST Vic). In the case of all other
incidents ST Vic requires incident reports within seven (7) days and a
finalised report within 30 days

The exemptions apply provided the stated safety controls and
undertakings detailed in the application form and associated documentation are
adhered to
