DECLARATION OF BOATING ACTIVITY EXEMPTION
 
Parks Victoria as the declared waterway manager for local Port of Port Phillp, makes the following declaration under section 203(3) of the Marine Safety Act 2010 (Vic).
 
For the purposes of boating activity conducted by Paddle Victoria, persons and vessels involved in the Peninsula Downwind Classic are exempt from the following requirements:
 
State Rules made under the Marine Act 1988
1.    Clause 2(a) – must not exceed 5 knots within 50 metres of a person in the water
2.    Clause 2(c) – must not exceed 5 knots within 50 metres of another vessel
3.    Clause 4(a) – must not exceed 5 knots within 200 metres of the water’s edge
4.    Clause 4(b) – must not exceed 5 knots within 50 metres of a wharf, jetty, slipway, diving platform or boat ramp
 
Waterway Rules made under the Marine Safety Act 2010 / Marine Act 1988
5.    *Clause 1.2.9(b) of Schedule 1 – areas prohibited to vessels at Mordialloc
6.    *Clause 1.2.9(g) of Schedule 1 – areas prohibited to vessels at Carrum
7.    *Clause 1.2.9(k) of Schedule 1 – areas prohibited to vessels at Frankston
8.    *Clause 1.3.9(a) of Schedule 1 – areas prohibited to vessels at Safety Beach
9.    *Clause 1.3.9(c) of Schedule 1 – areas prohibited to vessels at Rosebud
10.  *Clause 1.3.9(d) of Schedule 1 – areas prohibited to vessels at Rye
 
Subject to the conditions detailed below:
 
·      Competitors are only exempt from items 2 - 4 when competing in the events and items *5 - 10 when competing in the event at that location.
·      All participants involved with the event must wear a lifejacket at all times during the event.
·      All occupants of IRB rescue vessels involved with the event must wear a lifejacket at all times during the event and vessels must have all prescribed safety equipment.
·      The exemptions apply from 2.30pm to 4.30pm on Saturday 15 February 2025 (back-up date Sunday 16 February 2025) to the persons and vessels involved in the Peninsula Downwind Classic 2025.
·      In the event of any injuries which result in hospitalisation, a fatality or an incident involving a person or vessel not involved in the event, these must be immediately reported to Victoria Police and Safe Transport Victoria (ST Vic). In the case of all other incidents ST Vic requires incident reports within seven (7) days and a finalised report within 30 days.
·      The exemptions apply provided the stated safety controls and undertakings detailed in the application form and associated documentation are adhered to.
