PUBLIC NOTICE
DECLARATION OF BOATING ACTIVITY EXEMPTION
 
Parks Victoria as the declared waterway manager for Local Port of Port Phillip, makes the following declaration under section 203(3) of the Marine Safety Act 2010 (Vic).
 
For the purposes of boating activity conducted by Liveworks, persons and vessels involved in the Cool Your Jets event are exempt from the following requirements:
 
State Rules made under the Marine Act 1988
1.    Clause 2(a) – must not exceed 5 knots within 50 metres of a person in the water
2.    Clause 2(c) – must not exceed 5 knots within 50 metres of another vessel
3.    Clause 4(a) – must not exceed 5 knots within 200 metres of the water’s edge
 
Waterway Rules made under the Marine Safety Act 2010 / Marine Act 1988
6.    Clause 1.3.7 of Schedule 1 – 5 knot speed restriction within 500 metres of the water’s edge - South East Port Phillip
7.    Clause 1.3.12(a) of Schedule 1 – master of a personal watercraft must not operate the personal watercraft: for any purpose other than transiting in the safest most direct course to, or from the shore and/or a boat ramp or berthing facility (including a jetty, pier or mooring), whilst operating within designated 5 knot speed restriction zones

8.    Regulation 60 – Master must not engage in towing unless an observer is on board
 
Subject to the conditions detailed below:
 
·      Masters of PWC participant vessels are only exempt from items 3 & 6 when active in the event and unintentionally exceed 5 knots. All transit to and from the designated course must comply with speed and distance rules.
·      Masters of all PWC vessels are exempt from item 7 for the duration of the event.
·      All occupants of PWC vessels involved with the event must wear a lifejacket at all times during the event and vessels must have all prescribed safety equipment.
  • Filming/photographing and on-water activity to cease if users (vessels and people) not involved in the activity are within 50 metres of the filming/photographing and to recommence only once area is cleared, the exemptions will be automatically suspended until the vessel or person has moved outside of the area.
  • The exemptions apply from 11:00am to 2:00pm on Saturday 18 January 2025 to persons and vessels involved in the Cool Your Jets event within the exclusion zone waters – Local Port of Port Phillip (Safety Beach) – adjacent to the Safety Beach boat ramp as marked by buoys in the water extending up to approximately 200 metres from shore.
·      The exemptions apply provided the stated safety controls and undertakings detailed in the application form and associated documentation are adhered to.

Section 208(2)
NOTICE OF BOATING ACTIVITY EXCLUSION ZONE
 
Parks Victoria as the declared waterway manager for Local Port of Port Phillip, hereby gives notice under section 208(2) of the Marine Safety Act 2010 (Vic) that all persons and vessels not registered to take part in the Cool Your Jets event are prohibited from entering and remaining in the following waters.
 
Waters of Local Port of Port Philip (safety Beach) – adjacent to the Safety Beach boat ramp clearly marked by buoys in the water extending up to approx. 200 metres from shore.
 
The exclusion zone will be in effect from 11.00am to 2.00pm on Saturday 18 January 2025.
