I, Graeme Davis District Manager of Parks Victoria (as delegate of the Port Manager), determine under Regulation 11(1) of the Port Management (Local Ports) Regulations 2015 that the areas defined in the following table are set aside for the purposes and conditions specified.
 
This determination has been made in accordance with Regulation 11(2)
 (b)          if the port manager reasonably believes that there is imminent risk of—
(i)            harm or damage to—
(A)          the health or safety of any person; or
(B)           local port facilities or other property; or
(C)           the natural environment; or
(ii)           significant interference with the safe, efficient and effective management of the local port.
 
In accordance with Regulation 11(4), this determination replaces any previous set aside determination made by the port manager in respect of that area or any part there of that area for the period specified in this temporary determination. 
 
This determination applies from:
 
21st , 22nd & 23rd February 2025 between 8:45am – 4:00pm

As the Port Manager Waters of Western Port Bay, Parks Victoria has set aside an area of Western Port Bay to facilitate the Victorian Junior Lifesaving Championships organised by Life Saving Victoria at Point Leo Surf Beach on 21, 22nd & 23rd February 2025 between 8:45am – 4:00pm. The set aside prohibits all persons entering the area between times and dates as outlined. The full declaration including event information is available on Parks Victoria’s website.
 

PUBLIC NOTICE
DECLARATION OF BOATING ACTIVITY EXEMPTION
 
Parks Victoria as the declared waterway manager for Western Port Bay, makes the following declaration under section 203(3) of the Marine Safety Act 2010 (Vic).
 
For the purposes of boating activity conducted by Life Saving Victoria Limited, persons and vessels involved in the Victorian Junior Lifesaving Championships are exempt from the following requirements:
 
State Rules made under the Marine Act 1988
1.    Clause 2(a) – must not exceed 5 knots within 50 metres of a person in the water
2.    Clause 2(c) – must not exceed 5 knots within 50 metres of another vessel
3.    Clause 4(a) – must not exceed 5 knots within 200 metres of the water’s edge
 
Waterway Rules made under the Marine Safety Act 2010 / Marine Act 1988
6.    Clause 5.4 (c) of Schedule 5 – area prohibited to vessels at Point Leo Surf Beach

7.    Regulation 60 – Master must not engage in towing unless an observer is on board.
9.    Regulation 66(2) – person must wear a lifejacket of type specified at all times when underway on enclosed waters
10.  Regulation 70 – Master must ensure all occupants wear a lifejacket
 
Subject to the conditions detailed below:
 
·      Masters of rescue vessels (and PWC rescue) are only exempt from item 1 to 3 & 5 when undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety on shore and item 6 for the duration of the event.
·      Masters of PWC rescue vessels are only exempt from items 4 & 7 when retrieving or rescuing a person during the event and items 8 – 10 when retrieving or rescuing a person without a lifejacket from the water.
·      All participants on vessels involved with the event must wear a lifejacket at all times during the event and vessels must have all prescribed safety equipment.
·      Operators and occupants of vessels propelled by paddle or oar are exempt from lifejacket wearing requirements and the carriage of specified safety equipment whilst within visual range of a staffed lifesaving facility or flagged area, as per the Exemptions for Life Saving Victoria vessels in Exemption Notice 1.
·      Masters of mechanically powered LSV vessels up to and including 4.8 metres in length (other than PWCs) are exempt from the carriage of specified safety equipment whilst within visual range of a staffed lifesaving facility or flagged area, as per the Exemptions for Life Saving Victoria vessels in Exemption Notice 1.
·      The exemptions apply from 8:45am to 4:00pm on 21 – 23 February 2025 within the Set Aside waters of Point Leo beach.
·      In the event of any injuries which result in hospitalisation, a fatality or an incident involving a person or vessel not involved in the event, these must be immediately reported to Victoria Police and Safe Transport Victoria (ST Vic). In the case of all other incidents ST Vic requires incident reports within seven (7) days and a finalised report within 30 days.
·      The exemptions apply provided the stated safety controls and undertakings detailed in the application form and associated documentation are adhered to.
