DECLARATION
OF BOATING ACTIVITY EXEMPTION
Parks Victoria as the
declared waterway manager for Patterson River, upstream of the Nepean Highway Bridge to Eumemmering
Creek (including the National Water Sports Centre), makes the following declaration under section
203(3) of the Marine Safety Act 2010 (Vic).
For the purposes of
boating activity conducted by Seacraft Syndicate Boat Owners Club, persons and
vessels involved in the Seacraft Syndicate Boat Owners Club Carrum Regatta are exempt from the following requirements:

Clause 2(a) – must not exceed 5 knots within 50 metres of a person in
the water
2.
Clause 2(c) – must not exceed 5 knots within 50 metres of another vessel
3.
Clause 3(a) – must not exceed 5 knots within 50 metres of the water’s
edge

4.
A lifejacket of a type
described in Part 4 & 7 of “Schedule 1 - Types of Lifejackets”, of
the Marine Safety Regulations 2023 (MSRs) is modified to include a buoyancy
suit is deemed a Level 50S lifejacket or a Type 3 lifejacket if it is marked as rated at a minimum PFD-3 / Level 50S and manufactured to
Australian Standards AS 2260-1996 & AS 4758.1:2015.
Subject to the conditions detailed below:

Masters of rescue vessels are only exempt from items 1-3 when
undertaking a rescue operation to retrieve persons in distress, provide for
their initial medical or other needs and deliver them to a place of safety on
shore.
·
Competing water-skiers must wear a lifejacket or
buoyancy suit at all times that complies with item 4 modification that
adequately achieves the purpose of a Level 50S/Type 3 lifejacket.
·
Occupants of powered vessels used in conjunction with the event must
wear a lifejacket at all times during the event and vessels must have all prescribed safety equipment, including rescue
vessels.
· These exemptions apply from
9:00am to 5:00pm on 28 February 2026 to persons and
vessels participating in the Seacraft Syndicate Boat Owners Club Carrum Regatta
events on the waters of the National Water Sports Centre.
·
In the event of any
injuries which result in hospitalisation, a fatality or an incident involving a
person or vessel not involved in the event, these must be immediately reported
to Victoria Police and Safe Transport Victoria (ST Vic). In the case of all
other incidents ST Vic requires incident reports within seven (7) days and a
finalised report within 30 days.

provided the stated safety controls and undertakings detailed in the
application form and associated documentation are adhered to.
