Declaration of boating activity exemption and exclusion zone - Life Saving Victoria 2021

PUBLIC NOTICE
DECLARATION OF BOATING ACTIVITY EXEMPTION

Parks Victoria as the declared waterway manager for the Local Port of Port Phillip, makes the following declaration under section 203(3) of the Marine Safety Act 2010 (Vic).

For the purposes of boating activity conducted by Life Saving Victoria, persons and vessels involved in the LSV Carnival events detailed in Table 1 are exempt from the following requirements:

State Rules made under the Marine Act 1988

1. Clause 2(a) – must not exceed 5 knots within 50 metres of a person in the water;

2. Clause 2(c) – must not exceed 5 knots within 50 metres of another vessel;

3. Clause 4(a) – must not exceed 5 knots within 200 metres of the waters’ edge;

Waterway Rules made under the Marine Safety Act 2010 / Marine Act 1988

4. Schedules 1 and 5 – 5 knot speed restriction zones: South Melbourne 1.1.7(b), Mordialloc, Altona 1.5.7;

5. Schedule 1 – areas prohibited to vessels: South Melbourne 1.1.9(b), Mordialloc 1.2.9(b), Altona 1.5.9(a);

6. Regulation 96(2) and 100(1) – requirements in respect to carrying a PFD for each person on board and wearing a PFD.

Subject to the conditions detailed below:

  • Masters of rescue vessels are only exempt from 4 and 5 in the above list for the duration of each relevant event and items 1 to 3 when undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety on shore.
  • Masters of competing vessels are only exempt from 1 to 5 in the above list for the duration of each event.
  • Competing surf boats are only exempt from 6 in the above list for the duration of each event, provided the Surf Hazard Rating (SHR) is of a value no greater than 12. If the SHR is 13 or higher, the exemptions will apply subject to the following conditions:

    i. Competitors must wear helmets;

    ii. There must be two IRBs operating to follow the surf boats the entire length of the course;

    iii. Each IRB must be equipped with rescue tubes;

    iv. There must be officials on the shore to monitor the event and communicate with the IRBs via radio; and

    v. LSV must carry out a SHR assessment for each event.

  • The above exemptions are active for the times, dates, locations and events specified in Table 1 below, to operators of vessels associated with the events as noted on a list maintained by LSV within the exclusion zone waters, provided the stated safety controls and undertakings detailed in the applications form and associated documentation are adhered to.

NOTICE OF BOATING ACTIVITY EXCLUSION ZONE

Parks Victoria as the declared waterway manager for the Local Port of Port Phillip, hereby gives notice under section 208(2) of the Marine Safety Act 2010 (Vic) that all persons and vessels not registered to take part in the Life Saving Victoria events on 30 - 31 January 2021, 24 February 2021 on Mordialloc Beach, 21st February 2021 on Altona Beach and 13th February & 27th - 28th February 2021 on South Melbourne Beach are prohibited from entering and remaining in the waters adjacent to the Life Saving Clubs, which will be clearly marked by flags on shore approximately 200 metres apart, and in the water by buoys extending up to 350 metres from shore.

The exclusion zone will be in effect from 6:00am to 5:00pm on all dates, except 13th February 2021 will be in effect from 2:00pm – 8:00pm
